According the the SCO license it's illegal for anybody in the US to
export this software. Otherwise I expect several people would be
happy to oblige, since this is only a subset of the system software
and can only be used if you have a license. I don't know where you
can go from here, unless you contact SCO directly or somebody in the
EC can send it to you.

Hello again, i have set up an ftp server.
If a kind soul could upload either the SMP package from openserver 5.0.6
or the complete iso CD image, it would be marvelous !
Here are the details of the ftp server :
please ftp to fabien74.dyndns.org
login as "anonymous" and type any password
type "bin"
type "cd upload"
then if you are behind a firewall, type "passive" in your ftp client (hoping
it supports it!).
then upload using put ...

I forgot to mention I requested the 5.0.6 CDROM from our VAR but as I
expected
got no answer yet.
I will contact SCO to complain about this, hoping SCO can either send us
this CD or force the French VAR to send it.

The CD was never a free item. SCO always charged for it, and today they
would charge you even more for it: 5.0.6 is now a retired version of the
operating system, so SCO would consider it a special order.
So what kind of "force" are you thinking about?

We bought the "paper" license at the time (not a Web license as it is
possible today), so I thought
we should legally get the CD also. This was end of 2004.

Nope, you are not right in assuming that.
The media kit was always a "nominal" charge of $99 USD or so (I think it was 50-ish at one time), but it is a seperate and distinct entity.
You can buy one media kist and as many licenses as you like.
Lot's of big users use SCO in lots of turn-key and point-of-sale and special purpose black box type situations where a sco box is part of a phone system or monitors & controls machines in a factory or monitors sensors etc... just recently someone was having a problem with a sco box that was part of the machine that resets bowling pins in a bowling alley. Those companies have to buy usage licences for each physical machine, but they have no need or wish to put a box, books, and cd media kit with each machine. That would jsut be a ton of pointless overhead. They just have a few media kits in the shop where they assemble and install the machines is all, and maybe possibly in the vans of some of the service techs. And most of those install cd's are even ok to to be copies of one that was actually purchased, as long as they are all used by the same entity that purchased the original. It's probably not technically legal to re-distribute copies of a media kit, however, in reality before SCO became ... lets just say the entity it is today vs the entity it once was, no one actually cared and in fact to this day there is both Open Server 5.0.7 and 6.0.0 install cds available for public download right on the sco ftp site.
Most VAR's probably will buy a media kit to supply with a re-sold and/or value-added system, simply as a courtesy or as part of just generally being good thoughtful people and providing the customer with a complete package. We and every similar var I know personally does. But by no means is that a requirement nor even implied.
If they didn't say on their quote or on their invoice that they were supplying a media kit, or that they were charging you for one, then there is nothing technically/legally/morally wrong. Sometimes a detail like that isn't quite itemized even when the var in question normally does include a media kit. So it's not wrong to ask them if they intended to provide a media kit. But unless your invoice explicitly itemizes it, then it is wrong to accuse them of any wrong doing or demand they give you one for free now. All you really have the right to do then is just ask to buy one now and complain that they should have made it part of the original invoice just as part of providing a good complete self-contained package, like including a keyboard and mouse and monitor with the server, except even more so, since at least keyboards and mice and monitors can be purchased every day of the week from countless local brick & mortar stores.
