Different Image Type (0008,0008) in same Study Instance UID
as a short introduction:: all images within one and the same Series (thus the same Series Instance UID) should be from the same modality ...
but what is precisely the modality now?
(0002,0002) = Media Storage SOP Class UID=1.2.840.10008.5.1.4.1.1.2
(0008,0016) = SOP Class UID = 1.2.840.10008.5.1.4.1.1.2
0008,0060) = Modality = CT
I have the situation that the first image of a series (=same Series Inst. UID) is a
(0008,0016) = SOP Class UID = 1.2.840.10008.5.1.4.1.1.7 with (0008,0060) = Modality = CT
all subsequent images [in the series] are of the type
(0008,0016) = SOP Class UID = 1.2.840.10008.5.1.4.1.1.2 with (0008,0060) = Modality = CT
and some voices say "that this is a DICOM violation" ... but how can this be proven (either way) with the actual DICOM docs ??

this may not be a violation
Question : Can you export 2ndary capture with a CT modality ?
Open the PS3.3 chapter "C.184.108.40.206.1 Modality" and have a look to "note 3" :
"The modality listed in the Modality Data Element (0008,0060) may not match the name of the IOD in which it appears...."
so you can export 2ndary capture as CT modality.
Question : what is a series ?
You may want to read "A.1.2.3 SERIES IE" in "PS3.3" for series information:
4 criteria are defined for a series :
criteria a not a violation
criteria b : are the images spatially (same part of the body) and temporally (same screening session) related ?
criteria c : if both images are created by the same equipment it is not a violation
criteria d says it is not a violation
in my opinion you have to make your decision whether it is a violation or not by having a look to criteria b and c
